1. Acceptance of Terms
By accessing or using NexGen AI Studio ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.
2. Service Description
NexGen AI Studio provides AI-powered tools for content generation including but not limited to text, image, video, and audio generation. All tools are provided "as is" and "as available." We do not guarantee uninterrupted or error-free service. AI models may be updated, changed, or replaced at any time without notice.
3. User Obligations
You must be at least 13 years of age to use this Service. You are responsible for all content you generate using our tools. You must not use the Service for any illegal, harmful, or unauthorized purposes. You must not attempt to reverse-engineer, hack, or exploit the Service. You must not bypass rate limiting, content filters, or other security measures. You must not use automated scripts or bots to access the Service.
4. Intellectual Property
AI-generated content created through our Service belongs to you, the user, subject to applicable intellectual property laws. You grant us a non-exclusive, worldwide license to use anonymized, aggregated usage data for service improvement. Our branding, logos, code, design, and proprietary technology remain our exclusive property. You may not reproduce, distribute, or create derivative works from our platform without written permission.
5. AI Content Disclaimer
All outputs generated by our tools are AI-generated and may contain inaccuracies, errors, or unintended content. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. You must review all generated content before using it for any purpose. We are not responsible for any consequences arising from the use of AI-generated content. AI outputs should not be relied upon for medical, legal, financial, or safety-critical decisions.
6. Content Moderation
Automated content safety systems are in place to prevent the generation of harmful, illegal, or inappropriate content. We reserve the right to refuse service, suspend, or terminate accounts that violate our Acceptable Use Policy. Content that violates our policies may be reported to relevant authorities where required by law.
7. Payments and Credits
Free tier access includes daily usage limits and advertisements. Premium plans are available as described on our Pricing page. Payments are processed by Razorpay (India) and Stripe (international). We do not store payment card information on our servers. Credit purchases are generally non-refundable except as described in our Refund Policy. Subscription plans may be cancelled at any time, effective at the end of the current billing period.
8. Limitation of Liability
To the maximum extent permitted by applicable law, NexGen AI Studio and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless NexGen AI Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after modifications constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Chandigarh, India.
